Automobile accidents can happen to even the safest of drivers. The more time we spend on the road, the more likely it is that we will get into an accident. While some accidents cannot be prevented, an alarming number of recent accidents were completely preventable and were due to the same cause: distracted driving.

Distracted driving is any activity that could divert a person's attention away from the primary task of driving. It includes a number of activities, but most often refers to talking on a cell phone or texting while driving. The West Virginia legislature took note of the increased safety risk posed by distracted drivers and enacted laws last year to address this problem.

The legislature banned texting while driving and made it a primary law. By making it a primary law, the legislature gave police officers the authority to pull you over simply for texting while driving without any other reason. Using a handheld device while driving was also prohibited, but it was originally made a secondary law. An officer can cite you for violating this law if they pull you over for some other reason. However, this law is set to become a primary law on July 1, 2013. The text of that law can be found here.

Distracted drivers are dangerous drivers and cause accidents because of their negligent acts. If you or a loved one has been injured in an automobile accident because of a distracted driver, a West Virginia car accident lawyer can help you receive fair compensation for your injuries.
