Restauranteur sues CAMC for complications following medical procedure

CHARLESTON – A well-known Charleston restauranteur has sued CAMC and a doctor following complications a medical procedure.

Joseph Leonoro filed his complaint February 15 in Kanawha Circuit Court against Charleston Area Medical Center dba CAMC Urology and Dr. Ross Samuel Oliver Jr.

Leonoro and his brother Al own Leonoro’s Spaghetti House in downtown Charleston. The restaurant has been family owned and operated since 1915.

According to the complaint, Leonoro had a prostate biopsy performed September 8, 2020. It says a known complication of the procedure is post-operative infection which, if not treated properly, can lead to sepsis and other complications.

The next day, Leonoro called Oliver’s office to report a fever despite taking Tylenol. A nurse told him to “increase fluids and take Tylenol every six hours.” With no relief to his symptoms, Leonoro sought emergency medical treatment on September 10, 2020.

“By this time, Mr. Leonoro was in septic shock, and he would go on to suffer multiple cardiac events due to septic shock and additional injuries as a consequence of these cardiac events,” the complaint states.

Leonoro accuses Oliver of professional negligence and CAMC of vicarious liability. He seeks compensatory damages for medical expenses, physical pain and suffering, loss of earnings, annoyance, embarrassment, humiliation, inconvenience and loss of enjoyment of life. He also seeks punitive damages, pre- and post-judgment interest, court costs, attorney fees and other relief.

Leonoro is being represented by L. Dante diTrapano and David Carriger of Calwell Luce diTrapano in Charelston and by Richard D. Lindsay II and Dr. Richard D. Lindsay of Tabor Lindsay & Associates in Charleston. The case has been assigned to Circuit Judge Maryclaire Akers.
