Couple sues doctor, nurse for injuries from lipoma surgery

CHARLESTON — A couple is suing a surgeon and a nurse for injuries from surgery.

Dr. Josiah Kenneth Lilly III and Tamara Minnix were named as defendants in the suit.

John Stone was diagnosed with a subcutaneous mass in the bilateral lumbar region and presented to the Day Surgery Center for an excision of lipoma on his back on May 2, 2019, according to a complaint filed in Kanawha Circuit Court.

Stone claims his heart rate dropped into the 20s during the procedure and after it fell, he was administered CPR and was intubated, but he remained tachycardic. He was then transferred to Charleston Area Medical Center after his lower back incision was closed due to complications with anesthesia.

The plaintiff claims the defendants failed to properly monitor him during the surgery and caused him pain and distress, as well as permanent loss of bodily function, according to the suit.

Stone and his wife, Leona Stone, are seeking compensatory and punitive damages. They are represented by Bradley Dunkle, Dante diTrapano and David Carriger of Calwell Luce diTrapano in Charleston.

The case is assigned to Circuit Judge Maryclaire Akers.
